Who this article is for

This article is for EU/EEA citizens and their family members, and for non-EU partners, family members and students whose permit Migrationsverket has already granted, who:

  • were refused folkbokföring by Skatteverket, or
  • were told by Försäkringskassan that they are not försäkrad i Sverige (insured in Sweden) when applying for a benefit.

It is not for you if Migrationsverket refused the residence permit or work permit itself. Those decisions come from Migrationsverket (the migration agency) and follow other rules. Start at the permits hub. Citizenship refusals are covered in appealing a denied Swedish citizenship. Visitors, and anyone with a different kind of refusal, can use appealing a rejected decision in Sweden. A non-EU partner of an EU citizen should read about the EU family member residence card.

The general system (omprövning, överklagande, the court ladder) is explained in the foundation article on appealing a decision in Sweden. In one sentence: you challenge a beslut (formal decision) in writing, and a förvaltningsrätt (the first-instance administrative court) reviews it if the authority does not change it. This article only covers what is specific to these two refusals.

Prerequisites

Before the steps apply, check:

  • You hold a written beslut that has gone against you. Without one, there is nothing to appeal.
  • You are the person the decision concerns. Folkbokföringslagen (1991:481) 40 § lets the person a decision concerns appeal it.
  • You are an EU/EEA citizen or the family member of one, or a non-EU partner, family member or student whose permit Migrationsverket has already granted. A personnummer (Swedish personal identity number) is not a prerequisite. A refusal is often the reason you do not have one yet.
  • The deadline in the decision letter has not passed. It starts on the day you received the decision.

Step 1: understand why it was refused

Skatteverket: why folkbokföring is refused

Skatteverket registers you if you are bosatt (resident) in Sweden. Folkbokföringslagen 3 § says a person counts as bosatt if they can be expected to regularly spend their nights in Sweden for at least a year. For a foreign citizen who needs a residence right or permit to stay, 4 § adds a second condition: they may be registered only if that condition is met, or if there are exceptional reasons.

For EU/EEA citizens, Skatteverket says the plan must be to live in Sweden at least a year to work, study or live on your own assets. A refusal therefore often means Skatteverket did not see enough proof of one of these (this reading is ours; the decision letter gives the actual reason):

Your groundWhat Skatteverket asks you to show
WorkingYour anställningsavtal (employment contract), tjänstgöringsintyg (a certificate of employment) or another document that says you work, including the arbetstid (working hours) per Skatteverket
StudyingA register extract or other certificate that you will study at a recognised education, and that you can support yourself while studying; the law also requires comprehensive sickness insurance valid in Sweden for you and your family (utlänningslagen 3 a kap. 3 §), per Skatteverket
Own assetsThat you have enough money to live and support yourself for at least a year; the assets must support the whole family if they move with you; the law also requires comprehensive sickness insurance valid in Sweden for you and your family (utlänningslagen 3 a kap. 3 §), per Skatteverket
Family of an EU/EEA citizenProof of the relationship, such as a vigselbevis (marriage certificate) or, for sambor (cohabiting partners), a joint rental contract or shared bank accounts, and that your family member has uppehållsrätt, per Skatteverket

The one-year question matters too: what the one-year test means in practice.

Permit holders: why folkbokföring is refused

If Migrationsverket has granted you a residence permit, for example as a partner, family member or student, the same two tests apply. Your permit must be valid (folkbokföringslagen 4 §), and you must be expected to regularly spend your nights in Sweden for at least a year (3 §). A permit valid for less than a year is therefore the usual reason for a refusal. The appeal route is the same as for EU citizens: to Skatteverket, within three weeks (40 §).

Försäkringskassan: why "not insured" is the answer

Försäkringskassan writes that you are insured through where you live or work, and that the investigation of any benefit application starts by establishing whether you are insured in Sweden. For EU citizens its main rule is that you are insured in the country where you work. Work-replacing benefits mostly require that you work in Sweden; other benefits mostly require that you live here.

The law defines both routes. Socialförsäkringsbalken (2010:110, the social insurance code) 5 kap. 3 § says a person who comes to Sweden and can be expected to stay longer than one year is treated as bosatt, unless exceptional reasons speak against it. Arbete i Sverige (work in Sweden) means gainful work in operations in Sweden (6 kap. 2 §). Reasons that can lie behind a "no" (our reading of the rules above; check your decision letter):

  • you were seen as staying less than a year,
  • you work in another EU country, which then is where you are insured,
  • the evidence of where you live or work was thin, or
  • from 1 January 2027: socialförsäkringsbalken 5 kap. 2 § also requires that you stay in Sweden lawfully (lag 2026:853), so a missing residence right can itself be the reason.

You do not need folkbokföring to be insured. Socialförsäkringsbalken 5 kap. 11 § and 110 kap. 43 § cover a person who settles in Sweden without being folkbokförd and tell them to report to Försäkringskassan.

If you need a residence permit, residence-based benefits can be paid at the earliest from the day your permit starts to apply, and not for longer back than three months before it was granted (socialförsäkringsbalken 5 kap. 12 §).

Step 2: challenge the refusal

Folkbokföring: appeal to Skatteverket, three weeks

Folkbokföringslagen has no separate omprövning step. You överklaga (appeal) directly:

  1. Write the appeal. The decision comes with an appeal note, and Sveriges Domstolar says it states what you must write. Förvaltningslagen 43 § requires that you say which decision you appeal and how you want it changed.
  2. Send it to Skatteverket, not the court. Skatteverket forwards it to the förvaltningsrätt.
  3. Make sure it has arrived within three weeks of the day you received the decision (folkbokföringslagen 40 §, for decisions on registration under 3-17, 20, 21 and 22 §§; other folkbokföring decisions have no fixed time). A late appeal is rejected (förvaltningslagen 45 §), unless the delay was caused by wrong appeal information from Skatteverket, or the appeal reached the court in time.
  4. Skatteverket may change its own decision first. Förvaltningslagen 37 and 38 §§ let an authority change a decision it finds wrong, and 39 § allows this until the file has gone to the court.
  5. If the förvaltningsrätt rules against you, prövningstillstånd (leave to appeal) is needed to go to the kammarrätt (appeal court) (41 §).

A decision not to register you under your move notification goes to the förvaltningsrätt covering the place where you would have been registered (38 §).

Försäkringskassan: omprövning first, then appeal, two months each

Försäkringskassan requires the omprövning request in writing, with a form or a letter, and it must arrive within two months from the day you received the decision. Say which decision you want changed, how, and why. Försäkringskassan aims to send its omprövningsbeslut within six weeks, but it can take longer.

If the omprövning does not help, you write a letter of appeal, and it must arrive within two months of the day you received that decision. The law is in socialförsäkringsbalken 113 kap.:

StepRuleSection
Omprövning requestWritten; arrives within 2 months of receiving the decision7 §, 19 §
AppealTo a general administrative court; within 2 months of receiving the decision10 §, 20 §
Appeal sent too earlyTreated as an omprövning request10 §
Next instancePrövningstillstånd needed for the kammarrätt16 §
RiskOmprövning cannot change the decision to your disadvantage8 §

Which förvaltningsrätt: for a person bosatt in Sweden it is the court where your hemortskommun (home municipality) lies (14 §). The decision letter names the court.

Sveriges Domstolar notes there is no form, the appeal goes to the authority that made the decision, and the court charges no fee. You can get help from an ombud (a representative, such as a lawyer).

Step 3: what evidence to send

Answer the reason in the decision, and nothing else. Read the motivering (reasons) and match it to the test above.

  • Skatteverket, working: the contract with hours, or a certificate from the employer.
  • Skatteverket, studying: the register extract from your university, your statement that you can support yourself, and proof of comprehensive sickness insurance valid in Sweden for you and your family (utlänningslagen 3 a kap. 3 §).
  • Skatteverket, own assets: a kontoöversikt (bank overview), an intyg om pension (pension certificate) or other proof of enough money for at least a year, covering your family, and proof of comprehensive sickness insurance valid in Sweden for you and your family (utlänningslagen 3 a kap. 3 §).
  • Skatteverket, family: marriage certificate or a joint rental contract.
  • Försäkringskassan: the law's tests are living in Sweden with an expected stay beyond a year, or working in Sweden. Send documents that show your actual hemvist (home) or work: employment contract, study certificate, rental contract.

Check what Skatteverket asks at the appointment: what to bring to Skatteverket.

Step 4: what you can do while waiting

  • Keep the deadline. Submit the appeal or omprövning first, add documents afterwards if you need to.
  • Tell Försäkringskassan you live here. Skatteverket's refusal does not remove your duty to report. Under socialförsäkringsbalken 5 kap. 11 §, residence-based benefits (bosättningsbaserade förmåner) for a person who is not folkbokförd cannot be paid for longer back than three months before the month the report was made. If you got a personnummer or samordningsnummer (the coordination number given to people without a personnummer), give it, per Försäkringskassan.
  • Use your EHIC. Försäkringskassan says a patient insured in another EU/EEA country has the right to necessary care in Sweden at the same fee as residents. That is the rule for people who stay insured in their home country; it is not a substitute for being covered once you live here. Necessary care is care that cannot wait until you are back home. More: seeing a doctor before your personnummer arrives. Students: the one-year threshold for student health insurance.
  • If nothing is decided. After six months without a first decision you can ask the authority in writing to decide, and it must decide or refuse within four weeks (förvaltningslagen 12 §).

Mistakes to avoid

  • Sending the appeal to the court instead of the authority.
  • Treating "I will reapply" as a replacement for the deadline.
  • Missing a Försäkringskassan omprövning deadline because the Skatteverket case is still open. They are separate cases with separate clocks.
