A Swedish home is held in one of three legal forms. The form decides what you own, who can end your right to live there and which body settles a dispute. The forms are hyresrätt (a rented home), bostadsrätt (a co-operative apartment) and äganderätt (a home you own directly). This guide explains how the three fit together before any detail, so every later guide on housing has one place to point back to.

Who this article is for

This article is for anyone who rents or buys a home in Sweden, whatever their permit or nationality. It explains the system. It does not tell you how to find a flat or which queue to join.

It is not for visitors planning a short stay, who rent through hotels or short lets and do not enter any of these forms; start with how many days to spend in Sweden. For finding student housing, see the student housing queue guide. A student who rents a room or flat from a university or housing company usually holds a hyresrätt, which this guide covers.

Reading needs no prerequisites. Acting on a form does. For a bostadsrätt, the association board must approve you as a member. For äganderätt, you must apply for lagfart (registration of your ownership) within three months of the date of the purchase deed (köpebrev), jordabalken 20 kap. 2 §. What a landlord or bank asks for in documents, such as a personnummer, is the landlord's or bank's own requirement and not part of the tenure form.

The three forms and who runs each

Boverket, the National Board of Housing, Building and Planning, describes the forms in one sentence each. As of October 2026, per Boverket: "Hyresrätt innebär att en hyresgäst hyr en bostad av en hyresvärd."

A bostadsrätt is "en nyttjanderätt till lägenheten utan tidsbegränsning, tillsammans med medlemskap och ekonomisk andel i bostadsrättsföreningen." Äganderätt means that "en person äger sin bostad direkt."

In short:

  • Hyresrätt. You hold a tenancy agreement (hyresavtal). The landlord owns the building. The main law is jordabalken (1970:994), 12 kap. Hyresnämnden, the Rent Tribunal that settles rent and tenancy disputes, decides rent and sublet disputes.
  • Bostadsrätt. You hold a right to use the apartment, plus membership and a share in the bostadsrättsförening (the co-operative housing association), which owns the building. The main law is bostadsrättslagen (1991:614). The association board decides who joins, and hyresnämnden handles membership disputes and sublet refusals.
  • Äganderätt. You hold the property itself. The main law is jordabalken, including 20 kap. on lagfart. Lantmäteriet registers the owner.

Boverket also lists a fourth form, kooperativ hyresrätt, which it says "har drag av både hyresrätt och bostadsrätt". It is a minor form and this guide does not cover it further.

Hyresrätt: you rent and the landlord owns

In a hyresrätt you pay rent for the right to use the home, and the landlord owns it. Per Boverket, the landlord can be "ett kommunalt bostadsbolag, ett privat fastighetsbolag, en bostadsrättsförening eller en privatperson". The law that governs the contract is jordabalken chapter 12, which applies to agreements where "hus eller delar av hus upplåts till nyttjande mot ersättning" (12 kap. 1 §).

You can ask for the contract in writing. Under 12 kap. 2 §, "Hyresavtal skall upprättas skriftligen, om hyresvärden eller hyresgästen begär det." As a rule the contract runs until further notice: "Hyresavtal gäller för obestämd tid, om inte annat följer av andra stycket" (12 kap. 3 §).

You own nothing in the building. What you hold is the tenancy. When rent or a refusal is disputed, the route runs through hyresnämnden, covered in filing a rental dispute.

Bostadsrätt: you hold a right, the association owns the building

A bostadsrättsförening is, per bostadsrättslagen 1 kap. 1 §, "en ekonomisk förening som har till ändamål att i föreningens hus upplåta lägenheter med bostadsrätt". You do not buy the apartment as a property. You buy the bostadsrätt, which is the right to use that apartment, and you become a member.

Three rules in the law explain the form:

  • Membership is required: "Upplåtelse av en lägenhet med bostadsrätt får endast ske till den som är medlem i bostadsrättsföreningen" (1 kap. 3 §).
  • The right has no end date: it is granted "till nyttjande mot ersättning och utan tidsbegränsning" (1 kap. 4 §).
  • The board decides who joins: "Fråga om att anta en medlem i en bostadsrättsförening avgörs av föreningens styrelse" (2 kap. 1 §).

When a bostadsrätt is sold, the buyer gets the same treatment. Under 6 kap. 1 §, the new holder "får denne utöva bostadsrätten endast om han eller hon är eller antas till medlem i bostadsrättsföreningen". A purchase without board approval does not give you the right to use the apartment. If the board refuses you after you have bought, you can refer the dispute to hyresnämnden, but only "inom en månad från den dag han fick del av beslutet" (2 kap. 10 §).

The money side has two parts. The price you pay a seller buys the right and the membership, not the apartment as property. After that you pay the association an årsavgift (annual fee) for its running costs, which bostadsrättslagen 7 kap. 14 § allows it to charge. Ask for the amount and the association's annual report before you buy.

Skatteverket, the Swedish Tax Agency, adds a tax label. As of October 2026, it calls a bostadsrätt a privatbostadsrätt when more than half of the area is used for your own permanent or holiday home. The wording is "mer än 50 procent". The apartment must also sit in a privatbostadsföretag, a genuine housing association that provides homes to its members "till klart övervägande del (minst 60 procent)". The source is Skatteverket.

Äganderätt: you own the property and register it with lagfart

With äganderätt you own the home directly, most often a house (villa) but also an ägarlägenhet, an owned apartment that is its own property. Per Boverket, "Sedan den 1 maj 2009 är det möjligt att bilda ägarlägenhetsfastigheter."

Ownership has one extra step that the other forms lack: registration. Lagfart is the registered proof that you own a fastighet (a property). Jordabalken 20 kap. That is the date of the purchase deed. Lantmäteriet runs the register and puts it more simply, per its page on applying after a purchase: "Det ska göras inom tre månader efter förvärvet."

As of October 2026, lagfart costs money in two parts, per Lantmäteriet. One part is a fee to Lantmäteriet. The other, the tax stämpelskatt, is "1,5 procent" for private persons, bostadsrättsföreningar and kommuner, and "4,25 procent" for legal entities such as aktiebolag. It is calculated on the higher of the purchase price and the taxeringsvärde (the assessed value of the property), rounded down to the nearest thousand kronor.

Lantmäteriet's lagfart page speaks of a fastighet or a tomträtt (a site leased long-term). It does not list a bostadsrätt.

First-hand and second-hand contracts in each form

A förstahandskontrakt is a contract directly with the party that holds the rights: the landlord, the association or the owner. An andrahandskontrakt is a contract with someone who holds a right in the home and lets it onward. The two terms refer to who you contract with, not to whether the home is new or resold. Do not confuse an andrahandskontrakt with buying a resold apartment. The full comparison is in förstahandskontrakt vs andrahandskontrakt in Sweden.

  • Hyresrätt. A tenant may not sublet without the landlord's consent: "Hyresgästen får inte utan hyresvärdens samtycke hyra ut eller på något annat sätt upplåta lägenheten i andra hand …" (12 kap. 39 §). If the landlord refuses, hyresnämnden can give permission (12 kap. 40 §). The courts say the same on domstol.se: "För att få hyra ut en bostad i andra hand måste du först få det godkänt av hyresvärden eller hyresnämnden."
  • Bostadsrätt. The holder needs the board's consent: "En bostadsrättshavare får upplåta sin lägenhet i andra hand till någon annan för självständigt brukande endast om styrelsen ger sitt samtycke" (7 kap. 10 §). If the board refuses, hyresnämnden can give permission (7 kap. 11 §). The contract between you and the holder is a private let and falls under privatuthyrningslagen (2026:772), 1 §, as for a house or ägarlägenhet. The board's consent is a separate matter between the holder and the association. From 1 July 2026, the courts' own summary says it should become "lättare att få tillstånd från hyresnämnden".
  • Äganderätt. An owner, or a bostadsrätt holder, who is a private person and lets out their home does so under privatuthyrningslagen (2026:772). It applies from 1 July 2026 to a natural person or an estate that lets out a home, a villa, a bostadsrätt or an ägarlägenhet alike. It does not apply when the person letting holds the home by hyresrätt, or regularly lets more than two flats. Per Sveriges Domstolar, it replaces the earlier law on letting your own home.

The rent cap on subleases is covered separately in the andrahandskontrakt rent cap guide.

Who regulates what: rent, the association and lagfart

Rent in a hyresrätt is set by agreement. Under 12 kap. 19 §, "Hyran för bostadslägenheter ska vara till beloppet bestämd i hyresavtalet" or in a negotiated agreement under the hyresförhandlingslagen (the rent negotiation act). If landlord and tenant disagree, 12 kap. 55 § applies: "Om hyresvärden och hyresgästen tvistar om hyrans storlek ska hyran fastställas till skäligt belopp." Hyresnämnden decides that dispute, per domstol.se.

In a bostadsrätt, the law grants a right of use under bostadsrättslagen, not a tenancy under jordabalken 12 kap. The association board decides on membership under 2 kap. 1 §. Per Sveriges Domstolar, hyresnämnden covers disputes about it: it "medlar i hyres- och bostadsrättstvister och kan avgöra flertalet av dessa tvister genom beslut", including "Tvist om medlemskap i en bostadsrättsförening".

In äganderätt, Lantmäteriet registers the owner. The register records who owns the property, and the three-month deadline above applies to the buyer.

Who can end your right to live there

  • Hyresrätt, first hand. You have besittningsskydd (security of tenure). If the landlord gives notice, jordabalken 12 kap. 46 § entitles you to have the tenancy extended unless one of the grounds listed there applies, such as serious neglect of the tenancy, and hyresnämnden settles a dispute.
  • Bostadsrätt. The right runs "utan tidsbegränsning" (1 kap. 4 §). The association cannot end it at will, but it can be forfeited (förverkad) under 7 kap. 18 §, for example for late payment of the avgift or an unapproved sublet.
  • Äganderätt. You own the property. No landlord or association board can end your right to live there.
  • A private let (privatuthyrningslagen). Your position is weaker. A contract that runs until further notice "får sägas upp att upphöra att gälla vid ett månadsskifte som inträffar tidigast tre månader från uppsägningen" (6 kap. 2 §).

Which form you are in

Three checks settle it:

  1. You pay rent to a landlord and hold a hyresavtal. You are in a hyresrätt, even if the landlord is a bostadsrättsförening letting out one of its own flats.
  2. You are a member of a bostadsrättsförening and use the apartment without a time limit. You are in a bostadsrätt. Bostadsrättslagen calls it a right of use, not ownership of the apartment.
  3. The property is registered in your name, or you must apply for lagfart. You are in äganderätt.

If you rent a whole flat from a tenant, you are a second-hand tenant under jordabalken 12 kap. If you rent a whole flat from a bostadsrätt holder or an owner who is a private person, your contract falls under privatuthyrningslagen. If you rent a room in a home they still live in, you are inneboende (a lodger), a different position: 12 kap. 41 § lets a tenant take in others as long as the landlord "skäligen ska behöva godta" it. The order from andrahandskontrakt to bostadskö to lagfart shows how newcomers move between the forms in practice, and renting without a personnummer covers the first step. All housing guides sit under the housing hub.

Two cautions. The courts' older pages on subletting carry 2023 dates and predate the July 2026 changes, so read them next to the dates above. And the tenure form never replaces the contract: your actual rights are in the document you signed and the law version in force on that date.
